Terms and Conditions
In these Conditions the term Customer means the party named
above who uses the Antiques Info services and is responsible for payment,
Antiques Information Services refers to Antiques Information Services Ltd.,
publishers of Antiques Info; and the Services means those services and/or
information offered by Antiques Info from time to time for which the Customer
has agreed to subscribe
1. THE CUSTOMER'S RESPONSIBILITIES
Protective measures have been taken to prevent any unauthorised usage.
1.1 The Customer must ensure that the information provided to
the Customer by Antiques Information Services:
(a) is used only for the Customer's own personal or internal
use and (by way of example only) should not be sold, leased, rented or
otherwise supplied to any third party, in whole or in part;
(b) shall not be used in the compilation of or merged with any
directories or databases in any form or medium;
(c) shall not be stored electronically on any computer, or
backup device.
1.2 The Customer acknowledges that the special Password issued
to the Customer to enable access to the Services is for the use of the Customer
only and is not transferable and the Customer agrees not to permit its use by
or disclosure to any third party
1.3 The number of records that a subscriber may view is
restricted initially to two hundred per year for Specialists Dealers and Price
Guide databases, but this can be extended on request.
2. CHARGES
2.1 Charges are correct at the time of issue but may be
subject to amendment without notice at any time.
2.2 Payment is by credit/debit card only.
2.3 Value Added Tax has been added to all charges at the rate
applicable
3. COPYRIGHT
Copyright in all information published in Antiques Info and
Antiques Info Online and in any database of such information compiled for the
purpose of providing the Services is the property of Antiques Information
Services or its licensors and may not be copied sold licensed or reproduced in
any form or medium, save with the prior written consent of Antiques Information
Services
4. INDEMNITY
Without prejudice to any other rights or remedies which
Antiques Information Services may have the Customer shall indemnify Antiques
Information Services against any costs claim demands or expenses incurred or
sustained by Antiques Information Services by reason of any breach of these
Terms and Conditions.
5. LIMITATION OF LIABILITY
5.1 While Antiques Information Services attempts to ensure
that the Services provided are accurate and complete Antiques Information
Services does not make any representation or give any warranty, express or
implied, as to the accuracy or completeness of the Services or its fitness for
any particular purpose and any such warranty is hereby excluded
5.2 Neither Antiques Information Services nor its agents or
sub-contractors shall be liable to the Customer on any account (including in
negligence) for any loss (including any indirect or consequential loss) damage
cost or expense suffered or incurred by the User or other third parties arising
from the supply or use of the Services (including liability for any delay or
non-availability of the Services or any defects inaccuracies or errors therein)
6. DURATION AND TERMINATION
6.1 Antiques Information Services reserves the right to
terminate or withdraw the Services (in whole or in part) at any time without
notice. In such event the User will be entitled to a pro rata refund on any
subscriptions paid in advance
6.2 Antiques Information Services may suspend or terminate
supply of the Services without notice if (a) any charges are overdue (b) the
Customer is in breach of these Terms or Conditions
6.3 Delivery of subscription magazines to inland UK
destinations is by the Automated Press Stream. Royal Mail process and precede
the official publication dates by between 4 and the publication dates by a
minimum of 4 days.
6.4 AIS Ltd have an open policy relating to refunds. We will
consider refund requests on an individual basis where reasonableness of the
request will be prioritised as a matter of common policy.
6.5 Replacement products will be dispatched without cost
providing the addressee is not at fault. Multiple requests will be denied and
the subscription cancelled where costs to AIS become unreasonable.
6.6 Cancellation requests will be given reasonable
consideration in respect of web or magazine subscription services. A pro-rata
charge may be applied in respect of services already provided prior to the
cancellation request.
7. FORCE MAJEURE
Antiques Information Services shall not be liable for any
failure delay or omission arising out of any cause beyond its reasonable
control including (but not limited to) Acts of God, acts or regulations of
government or other authorities, fire, war, strikes or other industrial
disputes, power failure, failure of telecommunications lines, connections or
equipment or failure or defects in hardware or software
8. GENERAL
8.1 These Terms and Conditions shall form the entire agreement
between the parties regarding the Services and supersedes any prior agreements
or arrangements or understandings, written or verbal. No variation shall be
binding unless it is in writing signed by or on behalf of the parties
8.2 The invalidity or unenforceability of any term or any
right arising hereunder shall in no way affect the enforceability of the
remaining rights or terms
8.3 The Customer shall not be entitled to assign or transfer
any of its rights or obligations under these Terms and Conditions to any other
person
8.4 These Terms and Conditions shall be governed and construed
in accordance with English law
